Marijuana Crimes in Florida
Punta Gorda Criminal Defense Attorney
Drug crimes are some of the most heavily penalized crimes in Florida. Florida law
enforcement work hard to ensure that illegal substances stay off the streets
and out of the hands of children and other Punta Gorda residents. If you
were arrested for a drug crime and convicted, you can expect extremely
harsh penalties, including jail or prison time, fines, restitution and
probation. It is important that the moment you are arrested that you take
immediate action to protect your freedoms and defend your rights. With
the representation of a Punta Gorda criminal lawyer from our firm, you
may be able to receive a favorable outcome for your criminal case.
Penalties for Marijuana Offenses
Florida penalties for marijuana crimes vary depending on the amount that
was found on you or your property and if you had intent to sell that marijuana
or not. You may even be charged with a drug crime if you were found with
marijuana paraphernalia on you such as smoking apparatuses or joints.
If you were in possession of 20 grams or less of marijuana, you will be
charged with a misdemeanor crime and could face up to one year in jail
with a maximum fine of $1,000. Any more than 20 grams is considered a
felony and you could be spending anywhere between five and fifteen years
in incarceration and pay a maximum of $15,000 for your penalties.
Sales of marijuana are taken very seriously in Florida as well. Distributors
of 20 grams or less of marijuana may spend one year in jail and pay a
fine of $10,000. With each increase in the amount of marijuana that is
found in your possession, you will be facing a felony charge and may be
forced to serve up to thirty years in jail with a $200,000. If the sale
was made within one thousand feet of a school or park, regardless of the
amount, you will be charged with a felony and could pay steep fines of
up to $10,000. These crimes are very serious and need to be handled by
a dedicated attorney from our firm as soon as possible.
According to the Florida Criminal Code §893.13, .09, .13 and 775.082,
you will be charged with a crime if you are caught possessing or selling
marijuana. Regardless of how small the amount was that you were found
with, marijuana is still an illegal drug and needs to be treated as such.
Cannabis has received a lot of media attention over the past few months,
but it is still considered illegal by the United States federal government.
